Terms of Engagement

Mortgage Warehouse will confirm your instructions in writing. If we have provided you a fee mandate for the performance of your instructions then the fees set out in the fee mandate will apply, subject also to these Terms of Engagement.

Our Terms of Engagement

 

Your Instructions

Mortgage Warehouse will confirm your instructions in writing. Subject to these Terms of Engagement, we shall perform those instructions.

Professional Fees

Our fees will be based on having regard to the time spent by professional staff in performing your instructions, skill, specialist knowledge, and the responsibility on us arising from the value of any property or other issues involved, the importance and complexity of matters, the nature of the work and any urgency required.

If you request a fee estimate for the performance of your instructions then, when reasonably practicable, we shall provide that estimate in writing. In the event that your instructions are amended or varied, or the nature of your instructions require us to perform work that was unforeseen at the time of our estimate, then our estimate and any subsequent fee(s) may be varied accordingly.

If we have provided you a fee mandate for the performance of your instructions then the fees set out in the fee mandate will apply, subject also to these Terms of Engagement.

Expenses

Where applicable, office expenses will be charged separately, including photocopying, facsimile charges, telephone charges, postage, courier and similar expenses. We will also pass on to you any disbursements incurred by us on your behalf including, but not limited to credit reports, valuation expenses, and legal or other fees where applicable.

Accounts

Our accounts are due for payment 14 days following the date of the invoice, unless prior arrangements are made with us in writing. We will issue accounts monthly or on the earlier completion of this matter.

Please note that we charge interest on any overdue fees at a rate of 14% per annum. Also, you will be responsible for any reasonable debt collection costs that we incur in recovering any sum overdue for payment by you to us.

Termination of Agreement

Should you not be satisfied with any aspect of our service, we request that you advise us immediately so that we may discuss and review your concerns.

Subject to any specific mandate to the contrary, at any time, and for any reason, you may withdraw your instructions, however we request you give us notice immediately should this course of action be taken. 

We may cease to carry out your instructions in the event that:-

  1. you indicate that you have lost confidence in the company;
  2. we do not receive information from you in a timely manner;
  3. you fail to pay accounts when due;
  4. a conflict of interest situation arises.

Should we decide to cease carrying out your instructions, you will be given reasonable notice of our intention to do so.

Should you withdraw your instructions or we decide to cease to carry out your instructions, then we may charge you for fees and costs incurred up to the time when the relevant notice is given.

 

Our respective obligations

We will carry out the work you require with professional skill and diligence, and as far as reasonable, keep you informed of the progress of the matter.

In exchange, we request you make reasonable efforts to be available to give us information in relation to the work being carried out.

If we do not hear to the contrary, we will assume that you agree with all of the above terms and will proceed accordingly. If you conclude that you do not want our company to carry out your instructions, please inform us promptly.
